Terms of Use

01General

The site is run by the artist Ilya Magnes, Horev 9, Haifa, Israel (the “site operator”). It presents his painting, drawing, photography and music, and his lectures, workshops, evenings and performances.

If you do not accept these terms, please do not use the site.

02Using the site

The site may be used for lawful purposes only. You may not:

• Copy, systematically download, distribute or publish images of works, photographs, recordings or texts from the site without prior written permission.
• Use automated tools to harvest content from the site (scraping), including to train artificial-intelligence models.
• Interfere with the site or attempt to break into its servers.
• Use the contact form to send offensive, harassing, promotional or unlawful content.

The site operator may block access for anyone who breaches these terms.

03Works, prices and enquiries

The site is not an online shop: there is no basket and no payment is taken on it.

Prices shown on the site are given for convenience. An enquiry through the site is a request for details only, not an order. A sale is made only after direct arrangement and the site operator’s written confirmation, covering the work, the price, payment, framing and delivery.

An original is a single object; once sold, no identical piece can be supplied. Prints are made to order.

Images of the works are for illustration. Colour, brightness and texture may differ between a screen and the work itself, and the “on a wall” view is an illustration only.

A clerical error in a description, a size or a price does not bind the site operator.

04Workshops, evenings, lectures and performances

Bookings are made by direct arrangement. The price, deposit and cancellation terms are those shown on the relevant page of the site or given at the time of booking.

The site operator may postpone or cancel a meeting for reasons beyond his control (illness, the security situation, force majeure). In that case another date will be offered, or the amount paid will be refunded.

05Cancelling a purchase

Cancellations follow Israel’s Consumer Protection Law, 5741-1981, and the Consumer Protection (Cancellation of Transaction) Regulations, 5771-2010.

A distance sale may be cancelled within 14 days of receiving the work or the document setting out the sale, whichever is later. When the cancellation is not due to a defect, a fee of 5% of the price or ₪100, whichever is lower, applies, and the work is returned undamaged and in its packaging at the buyer’s expense.

Under section 14C(d) of the Law, a purchase of something made specifically for the buyer (a portrait or other commission, a print made to order, custom framing) cannot be cancelled once work on it has begun.

06Intellectual property

All rights in the works, photographs, music, recordings, videos and texts on the site, including copyright and moral rights, belong to Ilya Magnes unless stated otherwise.

Buying a work transfers ownership of the physical object only, not the right to reproduce, print or publish it.

Sharing a link to a page of the site is welcome, as is a short quotation with full credit to Ilya Magnes and a link to the source.

07Limitation of liability

The site and its content are provided “as is”. The site operator is not liable for any direct or indirect damage arising from use of the site, a technical fault or temporary unavailability.

08External links

The site links to outside services (such as WhatsApp and Google Maps). The site operator has no control over their content and is not responsible for it.

09Privacy and accessibility

Personal information is handled as set out in the Privacy Policy. How the site is made accessible is described in the Accessibility Statement.

10Language

The site is shown in English and in Hebrew. If the two versions of this document differ, the Hebrew version prevails.

11Changes to these terms

The site operator may update these terms from time to time; a change takes effect when it is published on this page. A sale already agreed is governed by the version in force when it was agreed.

12Law and jurisdiction

These terms are governed by the laws of the State of Israel only. The competent courts of the Haifa district have exclusive jurisdiction.
